This is the description of your section break.
By signing this contract you are agreeing to the following:

I. FEE PAYMENT
The Full Agreement & payment of a non-refundable $189 full balance is required at booking in order to reserve your session. The contract must be signed and session paid in full by 11:59pm on Monday, May 28th 2018, Memorial Day.
Price is $189. That includes talent of photographer, 15 minutes of photography session held on location at predetermined location and date, 5 high resolution files of your choice transferred digitally within approximately 2-3 weeks of your session. Additional digital images can be purchased for $30 each one.
Due to the nature of digital products/images, the Fee/retainer is NON-REFUNDABLE.
No other deals, coupons, discounts can be used in conjunction with this offer.

II. CANCELLATION
In the case of cancellation, we will gladly reschedule your session if notice of 48 hours is given. If no reasonable notice is given, or you do not show up for your session, you forfeit your entire session retainer and another will be required to reschedule. Session Fees/Retainers are non-refundable but may be used toward a rescheduled session in the event of an emergency with 48 hours’ notice.
If the Photographer is unable to perform to the guidelines of this contract due to a fire or other casualty, act of God, act of terrorism, or other cause beyond control of the parties, or due to a grave illness of the Photographer, then all fees paid by the client will be returned in full.

III. VIEWING THE IMAGES
Images will be available on our website approximately 2-3 weeks following your session date. Due to the nature of custom photography, all sales are final. No exceptions.

IV. DIGITAL FILES
All digital images include a print release to print the images at any lab of your choosing; however, All Colors Photography cannot guarantee the print quality of the lab you choose. If printed at a consumer lab (such as Wal-Mart, Walgreens, CVS, etc.), photos may not print as originally intended/showcased by the photographer. For local labs, we recommend Nelson Photo or Chrome, both in Little Italy San Diego, to achieve the best results. Online, we recommend mpix.com or you can print through me to achieve the best quality/durability available.

V. NEGATIVES
Images will be kept on file for two years following the date of your session. All images will be deleted after two years of the session date. Additional orders may be placed during this time.

VI. MODIFICATIONS
If the client has a request for a small alteration of an image, please let the photographer know when you place your order. The photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at $35/hr. The photographer will let you know if there will be extra charges before work begins. Once the requested changes are made, charges apply regardless of whether the final product is purchased.

VII. COPYRIGHT
All images taken at your session are copyrighted by All Colors Photography and are protected by Federal Copyright Law. Scanned or reproduced images are both illegal and a degradation of the original image quality.
You have the right to print the digital files you purchase at any lab of your choosing and/or using the files as you wish.

VIII. TRUTH IN PHOTOGRAPHY CLAUSE
Photography is an artistic interpretation of what a photographer sees when taking a photograph. The interpretation includes the subjects, the posing, the location available and the lighting available at the time of the session. There needs to be a level of trust between the photographer and the subject(s) for the end result to be pleasing to the subject and the photographer. If any party or parties in your session are unwilling to be open to posing or expression suggestions, it is best to discuss this with your photographer before the session begins.
There is no guarantee of the number of images presented from a session. Many factors contribute to this, including the cooperativeness of the subject.

IX. MODEL RELEASE
Chris Dowd and All Colors Photography retain the copyright of all original images and reserve the right to use and reproduce such images for any lawful purposes, but not limited to, advertising, website/blog, display, portfolio, or any publication to promote business free of compensation.

X. EXCLUSIVE PHOTOGRAPHER
It is understood that All Colors Photography is the exclusive official professional photographer retained to perform the photographic services requested on this Agreement.

I am the parent or legal guardian of any minor(s) named above and I have the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor.

COVID Notice & Waiver

While the State of California has eased or eliminated various COVID-19 based restrictions on businesses, the conduct and performance of the services being provided by All Colors Photography are subject to those rules in place at the time the photography services are to be performed. Client understands that any new or sudden regulations the State or Local Government imposes on businesses are beyond the Photographers control and Photographer cannot be held responsible for sessions having to be re-scheduled or canceled as a result. In the event an official order prevents session from taking place, the client will be given the choice at re-scheduling or applying any paid amount toward a future session.

Based upon the scope of the social distancing restrictions in place at the time of the photography services, certain aspects of the photographer/client interaction may be altered by necessity. Client and all members of Client’s party agree to abide by the social distancing measures in force
at the time of their session or event. Client and members of Client’s party explicitly agree and understand that failure to adhere to such social distancing measures places them at increased risk of COVID-19 exposure or transmission.

Client and members of Client’s party assume all risks associated with potential COVID-19 transmission or exposure in relation to the photography services being provided, and accept sole responsibility for an illness, injury, damages, claims or expense arising therefrom regardless of the identity of the person alleged to be at fault for such transmission or exposure.
