By signing this contract you are agreeing to the following:

I. FEE PAYMENT
The Full Agreement & payment of a non-refundable $190 Newborn Session/retainer is required at booking.
The Stay Home Newborn Sessions is a temporary newborn session solution while photography studios are not allowed to open due to the Covid-19 Pandemic. The session is done with the collaboration of the parents, who, guided by the photographer will take photos of the baby and send the files to the photographer so she edit them and create composites with pre-created backdrops.
Turnaround is 7 business days from your session from the date the photos are delivered by the parents, and you get 5 fully edited high resolution files - the final composites.
These photos are of baby only.
Files will be transferred digitally.
Due to the nature of digital products/images, the Fee/retainer is NON-REFUNDABLE.

II. CANCELLATION
Session Fees/Retainers are non-refundable but may be used toward a rescheduled session in the event of an emergency with 48 hours’ notice.
If the Photographer is unable to perform to the guidelines of this contract due to a fire or other casualty, act of God, act of terrorism, or other cause beyond control of the parties, or due to a grave illness of the Photographer, then all fees paid by the client will be returned in full.

III. VIEWING THE IMAGES
Images will be available on our website approximately 7 business days following the delivery of the original photos by the parents. Due to the nature of custom photography, all sales are final. No exceptions.

IV. DIGITAL FILES
All digital images include a print release to print the images at any lab of your choosing; however, All Colors Photography cannot guarantee the print quality of the lab you choose. If printed at a consumer lab (such as Wal-Mart, Walgreens, CVS, etc.), photos may not print as originally intended/showcased by the photographer. For local labs, we recommend Nelson Photo or Chrome, both in Little Italy San Diego, to achieve the best results.

V. NEGATIVES
Images will be kept on file for two years following the date of your session. All images will be deleted after two years of the session date. Additional orders may be placed during this time.

VI. MODIFICATIONS
If the client has a request for a small alteration of an image, please let the photographer know when you place your order. The photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at $35/hr. The photographer will let you know if there will be extra charges before work begins. Once the requested changes are made, charges apply regardless of whether the final product is purchased.

VII. COPYRIGHT
All images taken at your session are copyrighted by All Colors Photography and are protected by Federal Copyright Law. Scanned or reproduced images are both illegal and a degradation of the original image quality.
You have the right to print the digital files you purchase at any lab of your choosing and/or using the files as you wish.

VIII. TRUTH IN PHOTOGRAPHY CLAUSE
Photography is an artistic interpretation of what a photographer sees when taking a photograph. The interpretation includes the subjects, the posing, the location available and the lighting available at the time of the session. There needs to be a level of trust between the photographer and the subject(s) for the end result to be pleasing to the subject and the photographer. If any party or parties in your session are unwilling to be open to posing or expression suggestions, it is best to discuss this with your photographer before the session begins.
There is no guarantee of the number of images presented from a session. Many factors contribute to this, including the cooperativeness of the subject.

IX. MODEL RELEASE
Chris Dowd and All Colors Photography retain the copyright of all original images and reserve the right to use and reproduce such images for any lawful purposes, but not limited to, advertising, website/blog, display, portfolio, or any publication to promote business free of compensation.

X. EXCLUSIVE PHOTOGRAPHER
It is understood that All Colors Photography is the exclusive official professional photographer retained to perform the photographic services requested on this Agreement.

I am the parent or legal guardian of any minor(s) named above and I have the legal right and authority to execute the model release stipulations named in this contract on behalf of the minor.
