By signing this contract you are agreeing to the following:

I. FEE PAYMENT
The Full Agreement & payment of $370 + tax is required at booking in order to reserve your session. There is no remaining balance.
The Mother's Day Session regular price is $270.
The 2019 Cyber Monday Sale entitles is a second session (Valentine's Day Session Couples only or a Father's Day Session) for $100 ($170 discount) + 2 extra images to be used on any of the sessions ($60 value). This entire deal must be used in 2020. Each of the sessions includes talent of photographer, 15 minutes session held on predetermined location and dates, at least 30 professionally edited digital proofs that will be viewable in a private online slideshow within approximately 2 weeks of your session, 7 high resolution files of your choice transferred electronically. Additional digital images can be purchased for $30 each one.

Valentine's Day: February 8th, Saturday afternoon
Mother's Day: April 25th, Sunday - April 29th, Wednesday afternoon - May 9th, Saturday
Father's Day: June 13th, Saturday

Can be bought as gift. Cannot nor exchanged for money nor combined with other offers. Must be used on my predetermined dates in 2020 only.
Limit 1 per family.

Payment Options: All Colors Photography accepts Checks, Cash, PayPal, and Credit Cards.
Due to the nature of digital products/images, the entire Session Fee/retainer is NON-REFUNDABLE.

II. CANCELLATION
In the case of cancellation, we will gladly reschedule your session if notice of 48 hours is given. If no reasonable notice is given, or you do not show up for your session, you forfeit your entire session retainer and another will be required to reschedule. Session Fees/Retainers are non-refundable but may be used towards a rescheduled session in the event of an emergency with 48 hours’ notice.
If the Photographer is unable to perform to the guidelines of this contract due to a fire or other casualty, act of God, act of terrorism, or other cause beyond control of the parties, or due to a grave illness of the Photographer, then all fees paid by the client will be returned in full.

III. VIEWING THE IMAGES
Images will be available on our website approximately 2 weeks following your session date. Due to the nature of custom photography, all sales are final. No exceptions. Print & product completion times are determined by the lab, therefore please allow 1-4 weeks after your order is placed and paid in full to receive print & product orders. Specialty products may take 4-8 weeks to receive.

IV. DIGITAL FILES
All digital images include a print release to print the images at any lab of your choosing; however, All Colors Photography cannot guarantee the print quality of the lab you choose. If printed at a consumer lab (such as Wal-Mart, Walgreens, CVS, etc.), photos may not print as originally intended/showcased by the photographer. For local labs, we recommend Nelson Photo or Chrome, both in Little Italy San Diego, to achieve the best results.
However, I do provide printing, framing and custom design work if you would prefer not to deal with the hassle yourself and are looking for that extra professional service and quality.

V. NEGATIVES
Images will be kept on file for two years following the date of your session. All images will be deleted after two years of the session date. Additional orders may be placed during this time.

VI. MODIFICATIONS
If the client has a request for a small alteration of an image, please let the photographer know when you place your order. The photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at $35/hr. The photographer will let you know if there will be extra charges before work begins. Once the requested changes are made, charges apply regardless of whether the final product is purchased.

VII. COPYRIGHT
All images taken at your session are copyrighted by All Colors Photography and are protected by Federal Copyright Law. Scanned or reproduced images are both illegal and a degradation of the original image quality.
You have the right to print the digital files you purchase at any lab of your choosing and/or using the files as you wish.

VIII. TRUTH IN PHOTOGRAPHY CLAUSE
Photography is an artistic interpretation of what a photographer sees when taking a photograph. The interpretation includes the subjects, the posing, the location available and the lighting available at the time of the session. There needs to be a level of trust between the photographer and the subject(s) for the end result to be pleasing to the subject and the photographer. If any party or parties in your session are unwilling to be open to posing or expression suggestions, it is best to discuss this with your photographer before the session begins.
There is no guarantee of the number of images presented from a session. Many factors contribute to this, including the cooperativeness of the subject.

IX. MODEL RELEASE
Chris Dowd and All Colors Photography retain the copyright of all original images and reserve the right to use and reproduce such images for any lawful purposes, but not limited to, advertising, website/blog, display, portfolio, or any publication to promote business free of compensation.

X. EXCLUSIVE PHOTOGRAPHER
It is understood that All Colors Photography is the exclusive official professional photographer retained to perform the photographic services requested on this Agreement.
